  8. possession....
  9. Hey everyone,
  10.     Just got my information packet from NORML. Very responsive!
  11. I called their 1-900-97-NORML line last week, and requested
  12. some specific information, and here it is. I HIGHLY recommend
  13. EVERYONE to give it a call. There is a lot of good information
  14. there. (You can even speak to a LIVE NORML person during normal
  15. business hours.)
  16.     Anyways, back to the subject of this message. I got a copy
  17. of ALL the state laws regarding marijuana possession/sale/
  18. distribution, so I am going to repost SOME of it here. If you want
  19. a paper-copy, call NORML. Any questions, e-mail me.

  21. Notes: This chart contains the penalties for first offense
  22. possession, cultivation, sale and delivery of marijuana. Most
  23. states have increased penalties for subsequent offenses.
  24.  
  25. Many states also have enhanced penalties for involving minors
  26. and offenses within a certain distance of schools, parks, and
  27. other recreational areas.
  28.  
  29. Any amount for possession generally means for personal use.
  30. Possession of large amounts of marijuana will, in most cases,
  31. lead to charges of possession with intent to distribute (same
  32. as sale).
  33.  
  34. Units of weight vary from state to state.  For comparitive
  35. purposes: One ounce=28.35 grams; one pound=453.59 grams; and
  36. one kilogram=2.2 pounds.
  37.  
  38. Except where otherwise indicated, sentences are in years.
  39.  
  40. Except where otherwise indicated, fines are maximum amount.
  41.  
  42. 'C': State allows for the conditional release or alternative/
  43. diversion sentencing of first-time possession offenders.
  44. 'D': States where marijuana is decriminalized to some degree.

  47. use of marijuana for certain ailments such as glaucoma, nausea

  556. IMPORTANT NOTES: (State Specific)
  557. ALASKA: In 1975, the Alaska Supreme Court held that the right
  558. to privacy, as expressed in the state constitution, included the
  559. right of adults to possess up to four ounces at home for personal
  560. use. In 1990, Alaskans voted to recriminalize possession. The
  561. constitutionality of the statute is being challenged.
  562. ARIZONA: Offenders placed on probation or early release are generally
  563. required to perform from 24 to 360 hours of community service.
  564. ARKANSAS: Conveyances and real property are not subject to
  565. forfeiture in possession cases.
  566. CALIFORNIA: Conveyances are not subject to forfeiture in cases
  567. involving less than 5 lbs., or if the vehicle is the defendant's
  568. family's sole purpose of transportation. Delivery of less than
  569. 28.5 grams of marijuana for no renumeration carries the same penalty
  570. as possession.
  571. COLORADO: No forfeiture in possession cases involving less than
  572. 8 ozs. of marijuana.
  573. DELAWARE: No suspended sentences for marijuana offenses. 
  574. Conveyences are not subject to forfeiture in use or possession cases.
  575. DISTRICT OF COLUMBIA: First time possession offenders are eligible
  576. for probation followed by dismissal. No forfeiture of conveyence
  577. for possession offenses.
  578. GEORGIA: Conveyences are not subject to forfeitute in cases
  579. involving less than 4 ounces of marijuana and no other substances.
  580. IDAHO: A person's presence at a place where, with his knowledge,
  581. illegal drug activity is taking place, is a misdemeanor. No
  582. forfeiture of conveyence in possession cases.
  583. INDIANA: No forfeiture of conveyance in possession cases.
  584. KANSAS: Real property is subject to forfeiture in all felony offenses.
  585. KENTUCKY: The penalty for cultivating and harvesting marijuana
  586. for sale (possession of more than 254 plants is presumed to be
  587. possession for sale) is one to five years' incarceration and a fine

  590. violation. In July 1991, Louisiana recognized marijuana's
  591. medical use in the treatment of seizures and pain associated with
  592. paralysis.
  593. MAINE: Possession of more than 1.25ozs. is presumed to be unlawfully
  594. furnishing marijuana. Possession of more than 2 lbs. automatically
  595. triggers enhanced penalties for unlawful trafficing.
  596. MASSACHUSETTS: First time possession offenders are placed on 
  597. probation. No forfeiture of conveyance for possession of less than
  598. 10 lbs. Driver's license suspension for drug offenders.
  599. MICHIGAN: No forfeiture of conveyance.
  600. MINNESOTA: Possession of more than 1.4 grams in a motor vehicle is
  601. punishable by up to one year in prison and a $1,000 fine.
  602. MISSISSIPPI: Conveyances not subject to forfeiture in cases 
  603. involving less than one kilogram.
  604. MISSOURI: Delivery of less than 25 grams for no remuneration is
  605. punishible by one year in the county jail and/or a $1,000 fine.
  606. MONTANA: A minimum of one kilogram is required to trigger
  607. possession with intent to sell. No conveyance is subject to
  608. forfeiture in cases involving less than 60 grams.
  609. NEVADA: No forfeiture of conveyance in cases involving less than 
  610. one kilogram and no other drugs. Money in excess of $300 found with
  611. a person charged with distribution is assumed to be intended
  612. to purchase drugs and is subject to forfeiture. Persons under the
  613. age of 21 convicted of possession of less than one oz., may be
  614. sentenced to 1-6 yrs. and up to $20,000 fine, or up to one year,
  615. a fine of $1,000 and driver's license revocation of not more than
  616. six months.
  617. NEW HAMPSHIRE: Driver's license revocation for not more than 
  618. six months.
  619. NEW JERSEY: Persons convicted of a drug offense are automatically
  620. subjected to driver's license revocation of 6 mos. to two yrs.
  621. NEW MEXICO: Conveyances not subject to forfeiture in misdemeanor
  622. cases. 
  623. NEW YORK: Property not subject to forfeiture in misdemeanor
  624. cases. Delivery of less than 2 grams for no renumeration is a
  625. Class B misdemeanor. New York calculates fines by doubling
  626. the alleged proceeds from the drug activity.
  627. NORTH CAROLINA: The transfer of less than five grams of marijuana
  628. for no renumeration does not constitue delivery for penalty
  629. purposes. Conveyances not subject to forfeiture in misdemeanor cases.
  630. NORTH DAKOTA: Possession of up to .5 oz. while operating a motor
  631. vehicle is punishable by up to one year imprisonment and a $1,000
  632. fine.
  633. OHIO: IT is an offense to knowingly allow property or conveyances
  634. to be used in the commission of a felony drug offense.
  635. RHODE ISLAND: Persons convicted of possession but not sentenced
  636. to incarceration are required to perform community service and
  637. pay a fine of $400.
  638. SOUTH CAROLINA: Possession of more than 1oz. of marijuana is deemed
  639. to be possession with intent to distribute. Vehicles not subject
  640. to forfeiture in cases involving less than 1 lb.
  641. SOUTH DAKOTA: Conveyances not subject to forfeiture in cases 
  642. involving less than 1lb. Minors driver's licenses are subject
  643. to suspension.
  644. TENNESSEE: Conveyances subject to forfeiture in possession cases.
  645. TEXAS: Spending funds derived from the sale of more than 50lbs.,
  646. is in itself an offense punishable by 5-life or 99 yrs. and a
  647. fine of $50,000- $1,000,000. Delivery of less than .25 oz for
  648. no remuneration is a class B misdemeanor.
  649. UTAH: Suspension of driver's licenses for minors.
  650. VERMONT: No property may be forfeited in cases involving less
  651. than two ounces of marijuana and no other drug.
  652. WASHINGTON: Conveyances not subject to forfeiture in misdemeanor
  653. cases.
  654. WEST VIRGINIA: First time possession offenders may be placed on
  655. probation without further penalties. This is mandatory for first
  656. time possession offenders involving less than 15 grams.
